Last Chance to Oppose the Infanticide Bill AB 2223

Re:  Instruct the CCC to change its position on AB 2223 from “Neutral” to OPPOSED


Your Excellencies, 

Yesterday the California state legislature once again amended AB 2223, expanding its scope: 

(1) to include pregnant persons; 

(2) adding language to extend statutory protections to women coming from out of state; 

(3) thwarting investigations and enforcement of other states’ valid laws restricting abortion; 

(4) incorporating additional language from Proposition 1, the Abortion Amendment to the state contitution which the CCC rightly opposes. 


Now that the legislature has expanded AB 2223 once again, we humbly request that you, the Bishops in California and the voice of the Catholic Church, immediately instruct the California Catholic Conference (“CCC”) to change its neutral position on AB 2223, AB 2091 and AB 1666. Time is of the essence to oppose because the legislature can vote on this bill as soon as Monday [August 29, 2022]. 


AN ENTIRE SECTION HAS BEEN ADDED TO AB 2223, and will amend Section 123466 of the Health and Safety Code to read as follows:  

123466 (a) The state shall not deny or interfere with a woman’s or pregnant person’s right to choose or obtain an abortion prior to viability of the fetus, or when the abortion is necessary to protect the life or health of the woman or pregnant person.(b) A person shall not be compelled in a state, county, city, or other local criminal, administrative, legislative, or other proceeding to identify or provide information that would identify or that is related to an individual who has sought or obtained an abortion if the information is being requested based on either another state’s laws that interfere with a person’s rights under subdivision (a) or a foreign penal civil action, as defined in Section 2029.200 of the Code of Civil Procedure.


These latest amendments are designed to thwart the laws of other states that have worked tirelessly to promote a pro-life agenda.  They provide the CCC the opportunity to shift its position from neutral back to a position in opposition before the bill is taken up for a final vote on the Senate floor which could be as soon as Monday, August 29th.  


All bills must be voted on by August 31st.


Legislators are OPENLY using the CCC’s neutral position as a signal of the Catholic Bishops’ support for AB 2223. The bill’s author, Assemblywoman Buffy Wicks, and Senator Richard Pan both publicly credited the Catholic Bishops and the CCC for the language of this bill. They both defended the bill in committee, saying that the CCC “withdrew their opposition” and were able to insinuate that the Catholic bishops now support the bill. These legislators thanked the author for getting the Catholic Bishops to “come off this bill” and almost gleefully stated that the fact that the Catholic Conference went neutral “shows the work that was done.” 


Privately, legislative staff members have witnessed Senators laughing with the bill’s author, Aseemblymember Wicks, about the fact that the CCC has “come out of opposition” to AB 2223.


The CCC’s neutral stance on AB 2223 is inconsistent with the Church’s stance on our call to defend life at all stages. AB 2223 includes protections for infanticide – after the birth of a baby.  It does this with the language “perinatal death due to causes that occurred in utero,” the vague, undefined phrase that the CCC negotiated with the bill’s author.


It is not too late for the California Bishops to oppose AB 2223. PLEASE, RECONSIDER YOUR NEUTRAL POSITION!
